- Do not miss the dates on IRS letters. Reply the letters. File amended tax return for 2006. Request for waiver of penalty giving the reason why this happened. Read http://taxipay.blogspot.com/2008/04/list-of-articles.html
- Okay first of all I don't know who did your taxes but if they have a guarantee like H & R Block or someone like that I don't think it matters how long ago it was that the mistake was made. They made a mistake on your taxes and now it is their responsibility to fix it and represent you in front of the IRS. Here are some things you can do. Call the IRS 800-829-1040. Tell them what is going on that there was an obvious mistake in your taxes and the company that did them is refusing responsibility. You don't have the money to pay them and what your situation is, tell them you want to dispute the amount owed and that you want to file a formal dispute form. That should hold them off for a while. You need to sue the company that did your taxes and sue them for the amount the IRS now says you owe, plus another couple of thousand dollars because by the time it is resolved it will have cost you that much.
- Would help if you said WHY the IRS says you owe the money. If it was a stock sale that wasn't reported, you might not owe anything, or might owe a lot less that they think you do. Stay away from those people who advertise on TV. They'll just cost you money you don't have, and most likely not help you.
- Unless you find a very friendly lawyer who is willing to work for practically nothing the legal fees to sue the tax preparer will probably be close to the amount you owe the IRS. And if they made the kind of mistake that resulted in a bill of about $5,000, the chances are they won't know what they did wrong in the first place. The people who answer the phone on the number for the general public are usually the least experienced and they have a terrible record for giving accurate guidance. And getting help from the friendly IRS is often more difficult than getting help from someone in your area. If you belong to a church, there is very likely to be a few members who are tax preparers and you can ask them for guidance. Your minister or priest would be able to tell you who they are. Asking for help on the Internet isn't likely to help you solve the problem. You need to speak face to face with someone in your area who knows the tax rules and has experience in dealing with the IRS. A competent tax professional would most likely charge a lot less than what the IRS claims you owe them. And you may be able to ask them to let you pay them over time. That's assuming you can't find someone in your church who might help without charging you.
